These Terms of Service (“Terms”) govern your access to and use of www.lifeincapslock.com and any related services, content, features, or products (collectively, the “Services”) provided by Samantha Feher LLC dba CAPS LOCK, a New Jersey limited liability company (“Company,” “we,” “us,” or “our”). By using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase products or use the Services.

2. U.S.–Only Sales

We currently ship and sell products within the United States only. Orders placed for delivery outside the U.S. may be canceled.

3. Orders, Pricing, and Availability

All orders are subject to acceptance and availability. We may refuse, limit, or cancel any order at our discretion, including in cases of suspected fraud or pricing errors. Prices are listed in U.S. dollars and may change without notice. Taxes, shipping, and handling fees may apply and are shown at checkout.

4. Shipping, Risk of Loss, and Delivery

Shipping timeframes are estimates only and are not guaranteed. Risk of loss and title transfer to you when the order is delivered to the shipping carrier. You are responsible for providing accurate shipping information.

5. Returns, Refunds, and Damaged Items

All sales are final for hygienic purposes. We do not accept returns, exchanges, or refunds except for items that arrive damaged.

To request a damage-related refund, you must:

Email proof of damage (photos + order number) to samfehermedia@gmail.com, and submit your request within 7 days of delivery.

Requests submitted after 7 days or without sufficient proof may be denied. Approved refunds are issued to the original form of payment.

6. Product Information and Limited Warranty

We make reasonable efforts to ensure product descriptions and images are accurate, but we do not warrant that they are error-free or complete. Except as required by law, products are provided “as is” without warranties, express or implied.

7. User Content

If you submit reviews, comments, photos, or other content (“User Content”), you grant us a non-exclusive, royalty-free, worldwide license to use and display such content in connection with the Services. You represent that you have the rights to submit such content and that it does not violate any law or third-party rights.

8. Prohibited Uses

You may not: (a) use the Services for unlawful, fraudulent, or abusive purposes; (b) interfere with or disrupt the Services; (c) attempt to reverse engineer or exploit the Services; or (d) upload harmful, infringing, or misleading content.

9. Intellectual Property

All content on the Services — including logos, graphics, images, text, design, and software — is owned by or licensed to us and protected by law. You may not reproduce or use our intellectual property without written consent.

10. Disclaimer of Warranties

To the fullest extent permitted by law, the Services and all products are provided “as is” and “as available,” without warranties of any kind, express or implied.

11. Limitation of Liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Services or products. Our total liability for any claim shall not exceed the amount you paid for the product giving rise to the claim. Some jurisdictions do not allow certain limitations; in such cases, those limitations apply only to the extent permitted by law.

12. Indemnification

You agree to indemnify and hold harmless the Company and its owners, employees, and agents from any claims, losses, damages, or expenses arising from your use of the Services or violation of these Terms.

14. Governing Law

These Terms are governed by the laws of the State of New Jersey, without regard to conflict-of-law principles.

15. Binding Arbitration & Class-Action Waiver

Please read carefully — this section limits your legal rights.

Except for claims that may be filed in small-claims court, any dispute, claim, or controversy arising out of or relating to these Terms, the Services, or any products purchased through the Services shall be resolved by final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules.

Arbitration will be conducted by a single arbitrator in New York, New York (or remotely, if permitted by the rules or agreed by the parties).

Each party shall be responsible for its own attorneys’ fees, costs, and expenses, except as otherwise required by law.

No mediation is required prior to arbitration.

Class-Action Waiver: You and the Company agree that disputes will be resolved only on an individual basis and not as a class, collective, private-attorney-general, or representative action. The arbitrator may not consolidate claims or preside over any representative proceeding.

Opt-Out: You may opt-out of this arbitration provision by sending written notice to us within 30 days of your first purchase or first use of the Services. If you opt-out, Section 16 applies.

16. Jurisdiction & Venue (If Arbitration Does Not Apply)

If arbitration is not enforced or you opt-out, disputes shall be brought exclusively in the state or federal courts located in New York, and you consent to their jurisdiction and venue.

17. Changes to These Terms

We may update these Terms from time to time. The “Last Updated” date reflects the effective date of the current version. Continued use of the Services after changes become effective constitutes acceptance of the revised Terms.
